The NADvigators Podcast – Guest Appearance Terms & Conditions

By appearing on The NADvigators Podcast: Navigating the American Dream (“Podcast”), you (“Guest”) agree to the following terms:

1. Recording & Platform Distribution

You grant Bassey Simon and NADcast (nadcast.com) the irrevocable, perpetual, worldwide right to record, edit, reproduce, distribute, publish, transmit, publicly perform, and publicly display your audio, video, name, likeness, voice, image, and statements from the Podcast, in whole or in part.

This authorization includes distribution through, without limitation:
Spotify, Apple Podcasts, Google Podcasts, YouTube, YouTube Shorts, Instagram, Facebook, X (Twitter), TikTok, LinkedIn, podcast networks, NADcast-owned platforms, websites, email communications, and any current or future media platforms.

2. Ownership & Derivative Works

All recordings and derivative works created in connection with the Podcast are the exclusive property of NADcast. NADcast may clip, excerpt, remix, transcribe, caption, subtitle, or otherwise adapt the content for promotional, commercial, educational, archival, or editorial purposes without further approval.

3. Publicity Rights & Likeness Release

You expressly consent to the use of your name, likeness, image, voice, biography, professional title, and statements for publicity, marketing, advertising, and promotional purposes related to the Podcast and its affiliated projects, without restriction or compensation.

You waive any right to inspect or approve the finished content or its use.

4. GDPR & Data Protection Consent

Where applicable under the General Data Protection Regulation (GDPR) or similar data-protection laws, you consent to the processing of your personal data (including audio, video, and identifying information) for the purposes described in these Terms.

You acknowledge that:

• Processing is based on your explicit consent and legitimate interest in producing and distributing the Podcast
• Your data may be stored and processed in the United States or other jurisdictions
• You understand your rights to access, rectification, or restriction where legally applicable

You further acknowledge that once content is published, certain rights (such as erasure) may be limited where processing is necessary for freedom of expression, archival, or public interest purposes.

5. No Compensation

You confirm that your participation is voluntary and that no monetary or other compensation is owed now or in the future. You waive any claims to royalties, residuals, licensing fees, or other payments arising from the use or distribution of the content.

6. Editorial Control

You acknowledge that NADcast retains full editorial discretion, including the right to edit, shorten, rearrange, delay, archive, or decline publication of the interview, without obligation or liability.

7. Representations & Authority

You represent and warrant that:

• You have full authority to grant the rights described herein
• Your participation does not infringe upon any third-party rights or contractual obligations
• Your statements reflect your own views and experiences

8. Release & Hold Harmless

You release and hold harmless Bassey Simon, NADcast, its affiliates, partners, and distribution platforms from any claims, demands, or liabilities arising from the recording, publication, or use of the Podcast content, including claims related to privacy, publicity, defamation, or intellectual property.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict-of-law principles.
